Few questions about hosting

Hi, I've been looking around for a hoster that is relatively cheap and doesn't oversell like the majority of other shared providers and having 40 max per server is quite nice.  Everything looked fine, but I still have some questions regarding the ToS and some not.

(Note: If I did go with this service, I would be running a general forum and comic website for my friend)

First, i'll start with the ToS questions.

My question is, would this also encompass forum posts about torrent tracker websites?  Since a forum usually does end up with torrent and tracker discussions, I'd rather know if it could get me suspended/canceled.

Not to long ago I rented a dedicated box, fresh install and everything.  I got the windows firewall working and then went to download a more commercial firewall and also Peerguardian.  During that time, an unknown virus/trojan/person was able to log in and started doing port scans of every IP range so about 100-200 scans a minute.
Needless to say, after about 2 days I noticed that my server wasnt running as fast as it should, so I asked the tech support team.  They said my box was DOS'ing other servers and I had to find a way to stop it.  They gave me 48 hours after inquiring about it to fix the problem.  Couldn't find out since no logs showed anyone else logging in and out of 6 anti-virus/malware/spyware programs couldnt find anything either so I reformatted.

So, the basic point of the question is this: Will I be informed about any illegal activity on my box and be given adequate time to resolve the problem or will it be an immediate cancellation of service?

As noted at the top of the post, I only intend to run a general forum and as such anime discussions will arise.  Would an anime sub-forum be allowed?  I would assume posts about viewing anime would happen and links to site such as youtube and divx[something] would happen.  Would that be allowed?

If i may ask, what would be 'excessive' in the case of a kickstarter plan?
Also, if I would happen to be in 'excessive' use, would I be notified beforehand to possibly upgrade my service level or would i be suspended on the spot?

If I do happen to manage a site that uses quite alot of bandwith, will I be notified beforehand and at what percentage would that be?
Also, if I did manage to go over the quota before I could upgrade my service plan, what would happen? Would I be charged $x amount per gigabyte over before suspension ?

Ok, all the TOS questions over and more simple questions  ;D

1. Ive seen this service recommended for SMF forums which is what I was planning to use.  My question here is would a 'Kickstarter' plan with the following mods be able to handle about 40 constant users?  If it can, what would be your best guess for max online at a time?  No attachments would be allowed, and max avatar size of 100x100 300KB.

Tinyportal [Portal]
Ad Management Mod [Induces ads onto the forum in specific areas]
View Any Topic Permission Mod [Allows board(s) to have 'local' settings to where only certain usergroups can access or even so only staff members can view posts in that forum where normal users cannot but can still post.  Essentially a private support section]
Colorize Boards [Changes the forum index/child boards to be in color]

2. This is kind of asking the same question over (about linking to trackers), is it allowed in any form?  There are quite a few artists who release their music on trackers only so there is also legal content on them.

I do not mean deep-linking to the actual files or descrips (EX: www.trackername.com/search.php?Filename=copyrightedcontent.torrent) would a link to EX: www.trackername.com   be allowed?

Hi Iry,

Lets start with the TOS Questions:
#1 External Linking to outside sources are at the discretion of the webmaster. As long as that data is not stored on your home server this is fine. And as long as they are not deep linking to the source file.

#2 Depending on the degree of abuse that your site may be placing om the server. The servers are a community effort and each webmaster within any given server is responsible to a point were there site does not disrupt the server. If your site is disrupting the server to a point were it is adversely affecting the community of users. Then yes your site will be suspended immediately and without notice. Otherwise i will make every effort to work with you if the disruption is of a minor inconvenience.

#3 As was said in #1 external links are per the discretion of the webmaster. As long as that data is not stored on your home server this is fine. And as long as they are not deep linking to the source file.

#4 Excessive usage is per the discretion of our admins. Excessive usage is tied into the CPU/Ram/Mysql of any given server. G.C. Solutions tends to be more relaxed then other companies based on our accounts per server limits. Normally 10%CPU usage and MYSQL above 3.0 is considered Excessive usage if it is constant and runs for days at a time. Your site will not be supspended if any of those actions occur. I prefer to work things out with a customer and get them situated on the correct server for there applications.

#5 Within the billing area is a area for requesting to cancel your account.

#6 A email will be sent out when you have hit 80% of your bandwidth usage. Another Email will be sent after hitting 96% of your usage. You will be billed at 1$ per Gig for any over usage. If this is a constant issue then you may purchase extra bandwidth within your billing center,at the cost of $1 per Gig sold in 5Gig blocks. Your site will not be suspended for going over your server package specs. However your site will be suspended if you do not pay the overusage charge within 72 hours.

On to your personal questions:

#1A G.C. Solutions more or less specializes in forum applications. And I place the constant user max for the Kickstarter at 40. If you go above that usage you should be on the Hypercycle server simply because it was built in mind for forums that have a large constant or concurrent user count.

#1B TP and many other type mods are run on many sites that lay within the servers, This is not a issue.

#2 Linking to a outside websource is per the webmasters discreation. As long as the link is not deep and links directly to the source file.

Once again i cannot stress the importance that G.C. Solutions is a community of users and these users are contained within our servers. Your neighbors will be good to you in respect to the server. In exchange you must be a good neighbor to them.

If my site (which would include my friends comic space) got diggd and put on the first page, would I be charged for crashing the server?  :D
Incase you dont know (Which I doubt), any link on the front-page will result in that server being crashed due to the sheer amount of users trying to visit the site.

Wow, thanks for a fast and informed response ^_^

I will likely be going with you guys for hosting in the near future.  Actual humans for admins instead of those annoying bots/scripted humans.

Yes i know of the digg effect. well that would be a drag would it not. Its a very hard question to answer. Lets just hope it never happens. Because depending on what server you are on. I would have 30-40 customers screaming at me about there sites being down.

Just a interesting side note is all:

My personal site lays within the Kickstarter server (http://www.gotcanyons.net)

And yes if my site slows done or becomes non responsive. I will become one of those angery customers. So its easier for me just to keep the servers running in tip top condition. Depending on when you plan on coming. A server re-boot is going to happen April the 1st at 10:00PST :)

Nice site, now i have a semi-accurate guess of how big my site can get before I need to think about upgrading ^^

Is there an option where the site refuses connections after our monthly bandwidth is used up(shows a page that either displays a message, or gives an error)?

The basic page says. This site is suspended please contact billing. so if you dont wish to have to pay the extra transfer cost. I can have that page show up. Or you can redirect it yourself to a page of your choice if you are getting close to your limit. Just putting your forums in maint mode will do the trick.
